Authority

I welcome species of all ages to visit my website and enjoy my artwork, however you must be at least 18 years old in order to make a purchase from my art shop.

E-Mail and Site Communications

If you contact me via e-mail, you are authorizing me to reply via e-mail. I will not spam you, or send you unsolicited newsletters, unless you request to be spammed. ;)

You may use your account to communicate via Tell-A-Friend e-mails and post public reviews, so long as your actions and comments are not abusive, illegal, infringing, spamming, (insert your choice of negative synonyms) or otherwise objectionable; if you cannot show simple courtesy to myself and others, I reserve the right to remove your posts, delete your account, ban you, haunt your dreams, and report your ISP (depending on the severity of your conduct).

The positive reviews and feedback that you post in public areas of the website may be quoted by myself elsewhere on the web, to further promote my artwork or shop, without monetary compensation for you. Which means: I might quote your glowing feedback in my next eBay listing.

Copyright

As an artist, copyright is a huge deal for me. All the content on TaraFlyArt.com is copyrighted to TaraFlyPhotos, including my name, product descriptions, blog posts, artwork and graphic elements (unless otherwise noted... for example, the Zen-Cart logo, which is obviously copyrighted to Zen-Cart).
My artwork especially cannot be copied, distributed, or altered without my written consent. These rights are reserved to the artist and do not transfer to the customer purchasing the art. My work may not be reproduced and sold commercially. This includes custom fantasy portraits and commissions, unless we agree otherwise in writing.

Access License

I allow you to use my art-shop for personal use, to maintain your account, make purchases, post reviews, and share item URLs with friends... you may not copy any portion of this site and upload it elsewhere for commercial purposes. (i.e. cut-n-pasting MY item descriptions and/or images for use in your eBay or Etsy shop). You may not create any fictious accounts using my name and/or claiming to be me. ....I'm not sure who would want to, but you'd be surprised.

Third Party Websites

Throughout my site, I will link to outside websites to provide you with further information, or to share material I feel might be interesting to my customers and fans. I do my best to ensure these sites are reputable, however, I have no control over the content of these sites, and I cannot be held responsible for any pornagraphic material you may view, viruses you might download, etc. once leaving my site.
Please use caution when clicking any links, and do not download any material from unfamiliar websites.

Your Account

Please provide accurate information about yourself, and do not share your username and password, give anyone access to your computer, or allow your children to shop online with your credit cards. Pretty straight-forward, but I will not be held accountable if the dude in the library is looking over your shoulder.

I reserve the right to terminate an account if I feel justified that someone is giving false information. I will, however, notify the person of my suspicions first.

Applicable Law

You must recognize that I live, work, and am governed by the laws of Maryland within the United States. Any disputes will be subject to Maryland/US law... but there won't be any disputes, because I am a very nice person and so are my customers.

Limited Liability

I will not be liable for any indirect, incidental, special and/or consequential damages, loss of profits, emotional or bodily injury whatsoever resulting from the use or access of, or the inability to use or access, my website or its contents.
(Yes, the irony of experiencing bodily injury through a website did not escape me)

I cannot guarantee that my content will be error-free or that my server will be free from viruses, although I will do my upmost to maintain my site. I also cannot control the actions and comments of users, however if you discover any objectionable posts by members or website problems, please contact me immediately.

Modifications

I reserve the right to ammend my policies at any time, and the posted revisions will be effective immediately.
